For the MIVILUDES (Interministerial Mission for Vigilance and Fight against Sectarian Excesses), the drift or grip of a sectarian nature is defined as “a misappropriation of freedom of thought, opinion or religion that violates public order, laws or regulations, fundamental rights, safety or integrity of persons. It is characterized by the implementation, by an organized group or by an isolated individual, whatever its nature or activity, of pressures or techniques aimed at creating, maintaining or exploiting in a person a state of psychological or physical subjection, depriving her of part of her free will, with harmful consequences for that person, her entourage or society.” Every year, there is a steady increase in reports of sectarian events (+80% in 2021 compared to 2015), and public authorities as well as associations are witnessing the emergence and worrying increase of new practical forms. In addition to the drifts and movements already known, appeared new phenomena, more disparate, more atomized and moving: neo-shamanism, conspiracy, coaching and personal development, illegal practices of medicine, eco-otherism, platism, female shamanism, etc.

 

Mental control or sectarian subjection is sanctioned as an abuse of weakness, of which it constitutes an aggravating circumstance. The leader of fact or right of a group that pursues activities with the purpose or effect of creating, maintaining or exploiting the psychological or physical subjection of people who participate in these activities faces 5 years of imprisonment and 750,000 euros of fine. These penalties are increased to 7 years and 1 million euros fine if the offence is committed in an organized gang.

 

In France, it is the Central Office for the Repression of Violence against Persons (OCRVP), via the Assistance and Intervention Cell in the matter of sectarian abuses (CAIMADES), which has the public prerogatives to prosecute and suppress sectarian offences.
